Terms & Conditions – BellGo Track

1. Introduction
These Terms & Conditions ("Terms") govern access to and use of BellGo Track, including its:
- Web Application
- Android Application
- iOS Application
- APIs and related services
(collectively, the "Platform").
The Platform is owned and operated by BellGo Private Limited, having its registered office at:
47 Green Park, Yamuna Nagar, Haryana, India
("BellGo", "we", "us", or "our").
By accessing or using the Platform, you agree to these Terms.
2. Nature of Service
BellGo Track is a Software-as-a-Service (SaaS) workforce management platform designed for organizations to manage:
- Employee attendance
- Shift management
- Face-based attendance verification
- Live location tracking during active shifts
- Workforce monitoring
- Payroll processing and reporting
- Attendance analytics and operational reporting
BellGo Track is intended for legitimate business and workforce management purposes only.
3. User Eligibility
You must be authorized by your employer or organization to access and use the Platform.
You agree that all information provided by you is accurate and up to date.
4. User Roles
The Platform may be used by:
- Organizations / Employers
- Administrators
- Managers
- Supervisors
- Employees / Staff Members
Access permissions are controlled by the organization.
5. Account Responsibility
Users agree to:
- Maintain confidentiality of login credentials
- Not share accounts with others
- Promptly report unauthorized access
- Use the Platform only for authorized purposes
Users remain responsible for activities performed through their accounts.
6. Face Verification & Attendance
The Platform may require facial verification for attendance-related actions, including:
- Shift Start
- Shift End
- Attendance Verification
Users acknowledge that:
- Face verification is used solely for identity verification and attendance purposes.
- Camera permissions may be required to perform attendance actions.
- Failure to complete verification may prevent attendance registration.
7. Shift-Based Location Tracking
BellGo Track provides optional location tracking features that may be enabled by an organization.
When enabled:
- Location tracking begins only after a user voluntarily starts a shift.
- Shift start is initiated by the user through the Platform.
- Location tracking ends when the user voluntarily ends the shift.
- The Platform does not intentionally collect location data outside active shifts.
Location data may be used for:
- Attendance verification
- Work verification
- Workforce management
- Route monitoring
- Operational reporting
- Payroll-related calculations
Users may be required to grant foreground and/or background location permissions for proper functionality.
8. Employer Responsibilities
Organizations are responsible for:
- Informing employees regarding attendance and tracking policies.
- Obtaining any legally required employee consent.
- Ensuring compliance with applicable labor laws.
- Determining how attendance and workforce data is used internally.
BellGo acts solely as a technology provider.
9. Payroll Processing
BellGo Track may provide payroll-related calculations, reports, and attendance summaries.
Organizations remain solely responsible for:
- Payroll accuracy
- Salary calculations
- Tax compliance
- Statutory deductions
- Employee payments
BellGo does not guarantee payroll outcomes resulting from incorrect configurations or inaccurate attendance records.
10. Acceptable Use
Users shall not:
- Use the Platform unlawfully
- Attempt unauthorized access
- Circumvent security mechanisms
- Submit false attendance information
- Upload malicious software
- Disrupt Platform operations
11. Data Ownership
All workforce, attendance, payroll, location, and verification data belongs to the respective organization.
BellGo acts as a data processor and service provider on behalf of the organization.
12. Intellectual Property
All rights relating to:
- Software
- Source Code
- Designs
- Logos
- Trademarks
- Documentation
remain the exclusive property of BellGo Private Limited.
No ownership rights are transferred to users.
13. Data Security
BellGo implements commercially reasonable security measures including:
- Encryption
- Secure cloud infrastructure
- Access controls
- Authentication mechanisms
However, no platform can guarantee complete security.
14. Limitation of Liability
BellGo shall not be liable for:
- Employment disputes
- Payroll disputes
- GPS inaccuracies
- Device failures
- User misconduct
- Incorrect attendance records caused by user actions
- Indirect or consequential damages
To the maximum extent permitted by law, BellGo's total liability shall not exceed the fees paid by the organization during the preceding twelve (12) months.
15. Suspension & Termination
BellGo may suspend or terminate access:
- For violations of these Terms
- For security concerns
- For non-payment of subscription fees
- When required by law
Organizations may request data export prior to termination, subject to applicable agreements.
16. Force Majeure
BellGo shall not be liable for failures caused by circumstances beyond its reasonable control, including:
- Natural disasters
- Internet outages
- Government actions
- Cyberattacks
- Telecommunications failures
17. Governing Law
These Terms are governed by the laws of India.
The courts of Haryana, India shall have exclusive jurisdiction over disputes arising from these Terms.
